TERMS & CONDITIONS



Please read the following carefully as it contains information required by the State of Florida and is primarily for your benefit to ensure a safe and enjoyable vacation.

BOOKING CONDITIONS

A non-refundable $300.00 deposit or 20% which ever is greater per booking is required to reserve Goofy's Getaway, Dory's Lakeside Reef or King Louie's Palace. The deposit will be applied to the total rental cost with the balance due 8 weeks prior to the arrival date.

PAYMENT TERMS

The balance should be paid no later than 8 weeks prior to departure. If a booking is made within 8 weeks, full payment is due. The booking will be cancelled and the deposit forfeited for non-payment. Once the owners receive full payment for your reservation, the guests will be e-mailed a welcome packet that includes receipt, travel directions and lock box instructions to the home. The guest will be e-mailed the new lock box combination no later than one week prior to your arrival.

PAYMENT

We accept payments by Check or Cashiers Check drawn from a US Bank, Money Order, Visa, Mastercard or PayPal. FunInTheSunHomes will absorb all Credit Card fees for payments of deposit only. When paying in full or final balance, all Credit Card and PayPal Transactions will incur a 4% merchant service charge. This charge can be avoided by paying by Check, Cashiers Check or Money Order. Final Payments utilizing multiple cards will incur a $25.00 charge per Transaction. Credit card numbers are used only for payment processing and are not retained for marketing purposes. The credit card charges will be through FunInTheSun Vacation Homes. If a personal check is returned to us for non-sufficient funds, you will be charged the amount levied by the bank for NSF charges.

CANCELLATIONS

If you cancel less than 8 weeks prior to arrival, you will forfeit full payment.

At our discretion we may waive some of these charges. This will be dependant on us being able to successfully re-book the relevant weeks and subject to a $50 administrative fee.

The owners reserve the right to cancel a booking at any time and for whatever reason. In the unlikely event that the owners have to cancel a booking, other than for non-payment of final balance, all monies will be refunded in full.

SECURITY DEPOSIT

A credit card (VISA/Master Card) is required for the security/damage authorization. Shortly after check-in, an authorization will be put on the card. If the credit card authorization is declined, the owners reserve the right to refuse admittance to the home. After your stay, our cleaning service will inspect the home. If there is damage/loss, your credit card will be charged for repairs/replacement. If there is not any damage, the authorization on the card will be released within 10 days after departure. Please note that "normal wear and tear" will not be deducted from the credit card. Please do not try to make repairs yourself as this "could" compromise the next guests' safety. Please report all damage/accidents to the management company.

Our management company will inspect the property before and after your stay. Please note that guests are liable for any damage to the property or its contents even where the cost exceeds that of the security deposit.

HOME OCCUPANCY/PARTY SIZE

The property is fully licensed for short-term rentals in Florida. It is a condition of the booking that the number of occupants does not exceed the total occupancy for the home. Violation of this condition will result in the immediate removal from the property with no monies refunded. Every guest occupying the property must be listed on the booking form, including small children and the elderly. This is Florida State law and must be adhered to. Any changes to the guest list must be made in writing prior to your stay. The home may only be sub-let, shared or assigned by you with the owners express agreement, otherwise only by persons detailed on the guest registration and booking form are permitted to stay in the home.

King Louie's Palace maximum occupancy is sixteen (16) guests (no more than 12 adults) plus 1 infant, Dory's Lakeside Reef maximum occupancy is 14 plus 1 infant and Goofy's Getaway maximum occupancy is 12 guests plus 1 infant (and only those persons listed on the guest registration and booking form), and should the guest attempt to sleep more than the occupancy limit and falsify occupancy information at the time of reservation termination of the rental agreement will be implemented immediately, with no monies refunded. The owners reserve the right to refuse admittance if these conditions are not met. Failure to comply will render the booking void and no compensation will be paid.

HOUSEKEEPING

King Louie’s Palace, Dory's Lakeside Reef and Goofy's Getaway are self-catering homes having only an initial supply of consumables (garbage bags/toilet rolls/hand soap, etc.) Once these have been used it is NOT the responsibility of the management company to replenish these items during your stay.

They are professionally cleaned and inspected before and after each rental to ensure that all guests have a comfortable stay. Lawn and Pool care are provided on a weekly basis.

No pets allowed. Guests who bring a pet or pets without approval will incur a charge for the additional cleaning necessary to remove odours, dog hair, stains, etc. from the house and/or linens. Costs will be charged to the credit card.

These are non-smoking homes. You are permitted to smoke outdoors on the deck. Butts are to be disposed of properly and not left anywhere on the property. Any violation of the smoking policy will incur a charge for the additional cleaning necessary to remove smoke odours from the house and/or linens. Costs will be charged to the credit card.

Check-in time is no earlier than 4:00 pm EST. There is only a 6 hour window to completely clean, disinfect and set up for the next guests. Please respect this work schedule and do not arrive early. On occasions we may be able to extend this if the home is not immediately booked, and based on the owners discretion.

Checkout time is no later than 10 am EST the day you are scheduled to leave. The management company must be able to enter the home at 10 a.m. If you do not vacate the premises on time, you will be charged for one (1) additional night‘s stay.

Checkout procedures: Prior to checkout, all pool towels washed, dried and put back in the laundry room. All dishes should be washed and put away. Beds should be left unmade and sheets and pillowcases left in the laundry room. Towels should also be placed in the laundry hamper. If possible, please start a load or two of laundry prior to departure. All garbage should be put out in the trash. Make sure all doors and windows are locked and shut. All electrical appliances (lights, ceiling fans, TV’s, coffeemakers, etc.) turned off.

SWIMMING POOL

Please observe any signs posted in the vicinity of the pool. Pools can be great fun; however can pose a risk, especially to children. Our aim is to give you a perfect vacation, so please ensure the safety of any children staying at the home. It is particularly important that children are supervised at all times in and around the pool area, the pools depth is between 3 to 6 feet. The swimming pool is used at your own risk.

A safety screen is provided to make access for children more difficult but it is the responsibility of all guests to see children and non-swimmers are not left unattended. There is to be strictly no diving in the pool for safety reasons. There is to be no running around the pool edge in case of slippery surfaces. Please note that the surfaces leading onto the pool area from the home are tiled and these can also become slippery when wet. We do not accept responsibility for any loss or injury occasioned around the pool area.

To avoid any accidents from glass, only plastic-ware is to be used at the poolside and the “games room”. This is provided specifically for this purpose. If glass is broken in the pool a significant charge may be made for the draining and refilling of the pool along with repair to any damage to pool machinery.

POOL HEATING

Pool heating is an additional charge. The pool heater will heat your water to a comfortable range; usually this is 80 to 85 degrees. The pool heaters run approximately 10-12 hours a day. The pool water will be cool in the mornings and heat as the day goes on. During times of extreme weather (temperature dropping below 55 degrees) the pool heaters may not have the capacity to heat the pool to the normal range or may shu off. Pool heat refunds are not made for weather related causes. It is the guest’s responsibility to keep the pools solar insulating blanket in place at all times when the pool is not in use. Pool heaters are turned on 24 hours before your arrival and should be up to temperature when you arrive.

GAS GRILL

A Gas Barbeque Grill is provided for your enjoyment. It is NOT to be used inside the garage or screened in pool area. It should be returned to the garage when not in use with the propane gas tank turned off. It is the guest’s responsibility to clean the grill and surrounding affected area after each use. Any violation of the gas grill policy will result in a charge for the additional cleaning necessary to remove grill residue, grease, stains, spills, etc. from the house or driveway. Costs will be charged to the credit card. If the propane tank is empty and the guests wish to use the grill it is the guests responsibility to fill the tank. The owners will reimburse the guests the cost of filling the propane gas tank. Receipt must be provided to the owners.

LIABILITY DISCLAIMER

Understand that you and your guests are using our home at your own risk and the owners and the Management Company accept no responsibility and will not be held liable for death, personal injury, accidents, loss or damage to persons or personal belongings however caused while renting King Louie’s Palace or Goofy's Getaway. The use of all accommodations and amenities including the pool is entirely at the user’s own risk.

The owners and the management company cannot accept responsibility for the sudden failure of home equipment but will take immediate reasonable action to rectify any such failure upon notification by the guests. If the pool heater cannot reach optimum temperature due to any adverse cold weather conditions the owners or the management company cannot accept liability.

Provided at the home are a selection of pool accessories, DVD’s, game room including Pool Table, Ping Pong Table (King Louie's Palace), Foosball Table (Goofy's Getaway), Dual Electronic Basketball (Goofy's Getaway), TV with Play Station 2 (King Louie's Palace), PS2 games (King Louie's Palace), darts and other equipment for your added enjoyment. Their use is strictly at the guests’ own risk. Parents must use their discretion before allowing children to use any toys or equipment as to its suitability for their age. The owners and the management company cannot accept any responsibility for accident or injury from their use.

OWNERS/MANAGEMENT COMPANY ACCESS

The owners or their management company shall be allowed access at any reasonable time during your stay.

KEYS

There is one (1) key to the house in the lockbox. To ensure access to the house by all members of the party, always keep the key to the house in the lockbox when not in use. If you do not return the key, the owners will charge $25.00. If a key is not replaced in the lockbox, where provided, the charge will be $50.00. If you lock yourself out of the home call the management company. Charges will apply and are due directly to the Management Company or locksmith.

COMPLAINTS

Please note that, as Florida is a tropical State, insects such as ants and the like are occasionally inevitable, and are not cause for complaint. King Louie’s Palace and Goofy's Getaway are treated monthly as part of a pest and termite control program, and is professionally cleaned after each rental. Guests are requested to close doors and use the screens provided in the pool area to minimise the chances of unwanted pests. Ensure also that leftover food and other waste are disposed off promptly.

UNFORESEEN EVENTS

Unfortunately, there may be circumstances completely beyond the owners and the management company's control and contemplation, in which the property might not be available for your booking. Neither the owners and management company accept no responsibility or liability for loss or delay occasioned by, but not limited to, any of the following: strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, industrial disputes, fire, flood, technical/weather problems with transport, aircraft grounding, closure of airports or ports, weather conditions or indeed any other event beyond our or our management company’s control.

The owners and the management company cannot accept any liability for failure of public supplies such as water, electricity, gas supplies. Nor for the consequences of the actions or omissions of persons who may control or supply main services, or any actions taken in the vicinity of the property reserved, by any authority over which there is no control. The owners and the management company cannot accept any liability for air conditioning systems, or of pool heaters or any household appliances breaking down. All urgent steps will be taken, however to get the technician out as soon as possible to rectify the problem.
